TradingView Promotion Terms and Conditions

1. INTRODUCTION
   1. The account TradingView promotion is held by Skilling (Seychelles) Limited registration number 8425574-1 (hereinafter “Skilling”) authorized and regulated by the Financial Services Authority Seychelles (hereinafter the “FSA”), under authorization number SD042.
   2. The TradingView promotion is subject to these terms and conditions, you may be entitled to receive a free subscription to TradingView Pro (the “Promotion”)
   3. The Promotion is available to new and existing clients of the Company (“You” or “Your”) who are not resident in India, Pakistan, Indonesia, Russia, USA, Canada, Australia, New Zealand, Japan or any other of Skilling’s restricted countries, or a country within the EU/EEA (any other country a “Designated Country”).
   4. The Promotion is for introductory purposes for both new and for existing clients from a Designated Country who are interested in open and trade with a live account at Skilling.
   5. You agree by participating in the Promotion that You will be bound by these terms and conditions and Skilling’s ordinary client terms and conditions (including, if any, schedules or amendments) that apply to Your account and always subjective to any applicable laws (together the “Terms”).
   6. To ensure you are eligible to participate in the Promotion you need to:
      1. i) be resident in a Designated Country;
      2. ii) have a live trading account with us, and such account always being subject to the Terms;
      3. iii) and upon completion of the TradingView integration, You will need to connect your TradingView account to Your Skilling account to continue to qualify for a free subscription. Please reach out to Skilling’s customer support either via live chat or to [email protected].
      New clients must:
      1. a) fund the account with a minimum deposit of 250 CCY (“CCY” refers to the currency that your account is denominated in) to access the Promotion;
      2. b) have a notional trade volume of minimum 1,000,000 USD within 3 months from the day You access the Promotion. If the notional trade volume falls below 1,000,000 USD at any given time calculated in the previous 3 consecutive months, or the Company reserves the right to cancel the Promotion.
      Existing clients must:
      1. c) have a balance or fund the account with a minimum amount of 125 CCY, to access the Promotion;
      2. d) have a notional trade volume of minimum 500,000 USD within 3 months from the day You access the Promotion. If the notional trade volume falls below 500,000 USD at any given time calculated in the previous 3 consecutive months, or the Company reserves the right to cancel the Promotion.
      (collectively and/or separately for new or existing clients (the “Requirements”).
   7. The Promotion is only available in USD, GBP or EUR currency.
   8. If You reside within the European Union or the EEA, You cannot participate in the Promotion.
   9. The Promotion starts on the 20th of July 2021 at 00:01 AM Seychelles standard time (GMT+4).
   10. Subject to Skilling’s rights and provided You meet the Requirements, Skilling shall provide you with the Promotion as soon as reasonably possible.
   11. Skilling shall have the sole and absolute discretion in determining whether the Promotion can be awarded to You or not. Skilling further reserves the right to reject, impose a subscription fee or completely cancel the Promotion without prejudice if your participation is, or is likely to be, in breach of any Terms or any signs, or suspicions of fraudulent or manipulative behaviour.
   12. Skilling may in its sole discretion cancel or reverse the Promotion if made in error.
   13. If You have not performed any real money trading in Your live trading account for a period of 90 days or you do not qualify under the Requirements, Skilling reserves the right to cancel continued access to Tradingview Pro.
   14. You agree to indemnify, defend and hold harmless Skilling (including its directors, officers, employees and assignees) on written demand and at all times from and against any and all liability, fines, penalties, actions, judgement, settlement, claims, demands, losses, damages, injury, compensation, costs and expenses (including interest payments, reasonable legal fees on a solicitor/client basis, other professional fees and disbursements and costs of investigation and litigation) for or in respect of which Skilling will or may become liable by reason of or related or incidental to any act, default or omission and/or any breach of representation and warranty set forth herein by You under these Terms including without limitation resulting from or in relation to any breach, non- observance, act or omission whether negligent or otherwise.
   15. To the extent permitted by law, Your rights to litigate, to seek injunctive relief or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Promotion are hereby excluded, and You expressly waive any and all such rights.
   16. If this Promotion cannot be exercised as planned due to reasons beyond the control of Skilling, including but not limited to any technical problems or malfunctions, Skilling shall not incur any liability to you in connection with the Promotion.
   17. If any provision(s) of this Agreement are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
   18. Skilling reserves the right to change the terms of the Promotion or cancel it in its entirety at any time.
   19. These Terms shall be governed and construed in accordance with the laws of Seychelles. The parties irrevocably agree that the courts of Victoria, Mahe shall have the exclusive jurisdiction to settle any dispute arising out of or in connection with this Promotion.
   20. The Promotion is valid until the 31st of December 2021.
   21. Skilling reserves the right at its sole discretion to alter, amend, modify, suspend or terminate this Agreement, or any aspect of it, at any time and without prior notice. We will make reasonable efforts to notify You by email.
   22. You agree that we shall have the right, but not the obligation, to make any deductions and withholdings that we deem necessary or desirable under applicable tax laws, rules or regulations. You are solely responsible for the payment of any and all taxes, including but not limited to the local taxes that may apply to your participation in the Promotion.
